Estate Planning FAQs & Resources for Virginia Families
Welcome to the Berdan Law Resource Center—your hub for clear, trustworthy answers about estate planning in Virginia. We believe that informed clients make the best decisions, so we’ve gathered the most common questions, straightforward tips, and practical guides to help you understand your options before ever picking up the phone.
Do I need a will or a trust?
That depends on your goals. A will is a basic document, but it still goes through probate. A trust helps avoid probate and gives you more control. We’ll help you understand the pros and cons.
What happens if I don’t have an estate plan?
If you die without a will or trust in Oklahoma, state law determines who gets your assets—and the people you care about most might be left out.
How often should I update my plan?
We recommend reviewing your plan every 3 years or whenever there’s a major life change like a birth, death, divorce, or new asset.
Is estate planning only for wealthy people?
Not at all. If you own a home, have children, or simply want to stay in control, estate planning is for you.

How long does the whole process take?
From your first consultation to signed documents, most plans are completed within 4-6 weeks-depending on your pace and preferences.
What does the first meeting include?
It's 60-90 minutes focused on education. You'll learn how wills, trusts, guardianship, and powers of attorney work-then decide what makes sense for your family.
Do you offer payment plans?
Yes, we're happy to talk through options. We also work on a flat-fee basis, so you'll always know the cost up front.
Can I update my plan later?
Absolutely. Life changes, and your plan should keep up. We offer annual reviews and update support.
Estate Planning Basics
What does an estate plan include?
A complete plan covers your will, revocable living trust, power of attorney, and advance medical directive. Each plays a unique role—see our [Wills] and [Trusts] pages for more detail.
At what age or life stage should I start estate planning?
It’s never too early—once you own property, have savings, or start a family, it’s time to plan. Marriage, children, or a home purchase are common triggers.
How often should I review or update my estate plan?
Review every 3–5 years or after life changes like marriage, divorce, new children, or moving. Even if nothing major changes, regular check-ins keep your plan current.

How much does it cost to get an estate plan in Virginia?

What documents do I need to prepare for my first meeting?

Wills vs. Trusts & Document Comparisons
What’s the difference between a will and a living trust?
A will takes effect after death and goes through probate; a living trust skips probate, offers privacy, and can control asset distribution during your lifetime and after. Many families use both—see [Wills] and [Trusts] for more info.
Do I need both a will and a trust?
Not everyone does, but most clients benefit from having both—your will covers guardians and any assets outside the trust, while your trust avoids probate for titled assets.
Can I just use an online will kit or do I need an attorney?
Online kits may not follow Virginia’s witness rules or address unique family needs. An attorney ensures legal validity, customizes your plan, and avoids costly mistakes.
Special Situations & Firm Scope
Does Berdan Law handle probate or only planning?
